This property was rezoned to Marana VC (Village Commercial) in 2021. It has been my residence since 1960 and still has my home and several large awnings from my previous contracting business, Phil's Sheds & Garages. But these have little or no commercial value. I started a small food truck on the front of the property last year, but all leases are month to month.
Lessons Learned From a Previous Transaction
The property was recently in escrow which it fell through. But I learned several things from it:
- A phase 1 environmental assessment was done which showed no issues
- It should be easy to reduce the side yard setback to 5ft from the existing 20ft setback
- The market value is (at least) $1,200,000
- I need to pay more attention to any contingencies in the next contract
1. Unfortunately I don't have a copy of the phase 1 report. But an new one should have no issues either.
2. It should be easy to reduce the West side yard setback to 5ft from the existing 20ft setback. The side yard setback for VC zoning is 20ft. The purchaser went to the Town of Marana asking for a reduction to 1ft and the Marana Board of Adjustment offered 5ft. I have copies of all this paperwork to act as a template if a new purchaser wants to repeat the process and get a 5ft side yard setback on the West property line. This will considerably increase the usability (and value) of the property.
3. The contract price in the previous offer was $1,200,000. It was an arms length transaction which very nearly closed. My time frame for selling is 1-3 years and I have recently started a small food truck park which generates an income now. So I feel the current list price is appropriate based on the previous market activites, the ease and relative certainty of getting a reduced side yard setback, and my time frame.
4. I failed to ask enough questions about the contingencies I agreed on in the previous contract. And it came back to bite me. So I will pay closer attention to all contingencies in the future.
